Ford transmission problems and Texas lemon law (2026)

Common Ford transmission symptoms
Transmission complaints people commonly describe include: shuddering or vibration on acceleration, harsh or delayed shifts, slipping between gears, hesitation from a stop, gears that won't engage, and sudden loss of drive. (We aren't describing any particular model's defect rate โ this is a list of symptoms, not a claim about Ford vehicles.) If your dealer has reflashed the transmission software, replaced clutches or valve bodies, or told you the behavior is "normal" โ and the problem is still there โ the Texas tests below are how that repair history gets measured.
One important point: "normal characteristic" is the dealer's opinion, not a legal conclusion. Whether a shudder or harsh shift "substantially impairs the use or value" of your vehicle is decided by the evidence โ your repair history โ not by the service advisor's say-so. That's why the paperwork below matters so much.
The 4-times test and the 30-day test
Texas Occupations Code ยง 2301.605 presumes a "reasonable number of attempts" if, before the earlier of warranty expiration or 24 months / 24,000 miles after delivery:
1. Four-times test
The same transmission defect persists after 4 or more repair attempts. Different, unrelated defects don't combine toward the four. If one work order says "harsh shift 2โ3" and another says "transmission shudder," the manufacturer may argue those were different problems โ whether they count as the same nonconformity depends on the facts, which is why describing the symptom consistently matters.
2. 30-day test
Your Ford was out of service for repair a cumulative 30+ days and the transmission defect persists. Days need not be consecutive โ but days with a comparable loaner vehicle do not count. Add up every day the truck or car sat at the dealer, not just the days they were actively working on it.
3. Two-times test (serious safety hazard)
If the transmission loses drive at speed or stalls in traffic โ a life-threatening malfunction that substantially impedes control โ the test drops to 2 attempts. Safety-hazard cases get complicated; see the lawyer section below.

The 6-month deadline โ don't miss it
A Texas lemon law complaint must be filed within 6 months of the earliest of:
- Expiration of your express warranty term;
- 24 months after purchase; or
- 24,000 miles after delivery.

Written notice to Ford (certified mail)
Before you're eligible for repurchase or replacement, Texas requires you to give Ford Motor Company written notice of the defect โ preferably by certified mail, return receipt requested โ and at least one opportunity to cure it. Notice to the dealer alone is not enough; it must go to the manufacturer.
Your letter should: identify the vehicle (VIN), describe the transmission defect in your consistent words, list the repair attempts with dates, and state that you are giving Ford a final opportunity to repair under the Texas lemon law. How to file with the TxDMV
- Where: TxDMV Enforcement Division, Lemon Law Section โ online through the eLICENSING system (txdmv.gov โ Motorists โ Consumer Protection โ Lemon Law), or by requesting the Lemon Law Complaint Form at 1-888-368-4689.
- Fee: $35 โ verify the current amount on the TxDMV site before filing.

What happens after you file
- Eligibility check โ TxDMV Lemon Law staff review your complaint.

- OAH hearing โ if that fails, a hearing before a neutral examiner at the Office of Administrative Hearings: exhibits, witnesses, cross-examination, closing statements. You may represent yourself.
- Decision and Final Order โ the examiner's decision. Remedies for new vehicles: repurchase (price + taxes/title/license minus mileage offset) or replacement (comparable vehicle acceptable to you).
Evidence checklist for Ford transmission cases
- Every repair order โ especially ones noting shudder, slip, harsh shift, software reflash, clutch or valve-body replacement, or "could not duplicate";
- Your consistent symptom description, in your own words, dated after each visit;
- Video of the symptom if capturable safely (a shudder on camera can be useful evidence);
- Days-out-of-service log with loaner noted (loaner days don't count);
- Certified-mail receipt for your notice to Ford;
- All Ford/dealer correspondence, including any "normal characteristic" statements in writing.
