The Texas lemon law hearing: what to expect (2026)
Filing the complaint is only step one. Here's the full road from filing to decision โ the TxDMV's informal resolution, the prehearing conference, the hearing before the examiner, and the Final Order โ so nothing surprises you. Last reviewed September 30, 2026.

Step 1: TxDMV eligibility check
Your complaint goes to the TxDMV Enforcement Division, Lemon Law Section โ filed online through the eLICENSING system (or via the Lemon Law Complaint Form, 1-888-368-4689), with the $35 filing fee TxDMV lists (confirm the current amount before filing). TxDMV Lemon Law staff first check eligibility and enter your repair and purchase history into eLICENSING. The core requirements TxDMV lists include a new vehicle from a licensed Texas dealer, a defect reported within the warranty term, written notice to the manufacturer, and filing within 6 months of the earliest of warranty expiration / 24 months / 24,000 miles.
Step 2: informal resolution
Before anyone sees a hearing room, your case goes to a TxDMV case advisor โ staff with automotive technical expertise โ who runs an informal resolution process between you and the manufacturer. Take this stage seriously and have your repair history organized and ready.
Step 3: the prehearing conference
If informal resolution fails, the complaint is referred to the Office of Administrative Hearings (OAH). First comes a prehearing phone conference. Treat it seriously, and follow any instructions you're given there.
Step 4: the hearing itself
The hearing is before a hearings examiner โ a licensed Texas attorney serving as a neutral adjudicator. It's like a trial but more informal:
- Exhibits: your repair orders, certified-mail receipt, correspondence, photos/video, days-out-of-service log;
- Witnesses: witnesses can testify;
- Cross-examination: each side may question the other's witnesses;
- Closing statements: your summary of why the tests are met and what remedy you seek.
The examiner โ a neutral adjudicator โ hears the evidence from both sides and decides the case under the Texas lemon law.
Representing yourself
You may represent yourself; attorneys are allowed but not required, for either side. If your case involves a safety hazard, a denied claim, or a deadline under 30 days, talk to a licensed attorney first. Step 5: the Decision and Final Order
The hearings examiner issues a Decision and Final Order. For new vehicles, the remedies are:
- Repurchase (refund): purchase price including taxes, title, and license fee, minus a usage offset based on mileage at the hearing (interest excluded);
- Replacement: a comparable vehicle acceptable to you, minus mileage used โ you pay for any upgrades;
- Repair: the manufacturer must fix the defects; out-of-pocket costs for repairs that should have been warranty-covered may be reimbursed.
How to prepare (checklist)
- Every repair order in chronological order โ including "could not duplicate" visits;
- Certified-mail receipt + copy of your written notice to the manufacturer;
- Buyer's order / lease agreement and warranty booklet;
- Days-out-of-service log with loaner days marked;
- A one-page timeline: delivery date โ each repair visit โ notice date โ filing date;
